TICKET TERMS & CONDITIONS

By purchasing a ticket to the Marlborough Wine & Food Festival (the Event) you agree to the terms and conditions set out by Wine Marlborough Ltd (the Promoter) below. These terms and conditions should be read in conjunction with all statements and directives shown or displayed on your Ticket, on-site at the Event, on the Promoter’s website and social media pages, or otherwise communicated by the Promoter from time to time.

1. If the Event cannot take place (in whole or in part) due to an event, circumstance, or situation outside of the Promoter’s reasonable control (including but not limited to any act of God, natural disaster, fire, flood, council or government sanction or order, actions or decisions of police or other authorities, act of terrorism, war or industrial action, or cancellation by the Venue owner, lessee or controller) (“Force Majeure Event”) then the Promoter may, at their sole discretion may cancel or amend the Event.

2. In the event of a cancellation, your ticket price will be 100% refundable (excluding payment fees by the purchasing system provider). However, if the Event is postponed, relocated or changed for whatever reason, the Promoter shall not be liable for any additional compensation, loss or other expenses such as transport or accommodation.

3. Unless the Event is cancelled, tickets are non-refundable and name changes cannot be made

4. These Event Terms and Conditions can be updated by the Promoter at any time without warning.

5. Admission is at the Ticket Holder’s own risk. The Promoter will not be held liable for any loss, injuries or damages sustained at the Event including damage, theft, illness, or losses to property.

6. The event strictly R18+ This means that no person under the age of 18 will be admitted, regardless of their circumstances. This includes babies, infants and children.

7. The Ticket Holder may be required to provide proof of age when arriving at the Event, when purchasing alcohol or at any time this is requested by authorised personnel. ID must take the form of one of the following types of identification: A HANZ Card, Kiwi Access Card, a New Zealand Drivers License, New Zealand or Foreign Passport.

8. A photographer may be present at the Event capturing imagery on behalf of the Event and or the Promoter. By entering the Event you agree that any images you may be included in can be used as promotional content in publications or marketing material, including but not limited to website, social media channels and printed collateral. If you do not wish to be photographed, please politely ask our photographer to not photograph you.

9. The Event will use a festival purchasing system that helps reduce queues at stalls, improves access control and supports health and safety. No wine or food stall will accept cash or Eftpos. Ticket holders will receive more information closer to the time of the event.

10. The Ticket Holder consents to and will permit to the search and inspection of his or her person, clothing, bags or other possessions by any registered crowd controller of the proprietor of the venue and/or the Promoter of the Event.

11. Management reserves the right to prohibit entry to, or remove from the Event, any person under the influence of drugs and alcohol or showing disorderly or inappropriate behaviour.

12. No food or beverage may be taken to the Event. If you have a strict allergy and need to bring your own food, you must apply for an exemption by emailing events@wine-marlborough.co.nz. If granted, you must have your exemption letter with you at the Event.

13. If permission is given when purchasing a ticket to the Event, the Ticket Holders consent to their contact details being used by the Promoter for communication about the Event and subsequently any future events organised by the Promoter. The Ticket Holder can unsubscribe at any time.

14. The Event is 100% smoke-free, any ticket holder smoking on site may be asked to leave the event.

15. No Refund Policy

The Event maintains a strict no-refund policy. A formal Ticket Return Marketplace will be available for resell closer to the time of the Event, providing the opportunity for ticket holders who cannot attend the Event to list tickets for resale to be purchased by other users, this function will be available closer to the time of the Event and only once the ticket type allocation has sold out.

Ticket Return Marketplace Terms and Conditions

1. Introduction

These Ticket resale Terms and Conditions ("Terms") govern the resale of event tickets by ticket holders ("ticket holders") using the Reseller Platform ("Ticket Return Marketplace"). By listing or purchasing a resale ticket, you agree to these Terms.

2. Listing Tickets for Resale on ticket return marketplace

Ticket holders may list their tickets for resale through the Platform by accessing the "My Tickets" section and following the prompts. Once listed, the ticket will be available for purchase by other users. Ticket holders retain the right to remove their ticket from resale at any time prior to its sale by utilizing the "Cancel" option within the Platform. The Event/ promoter may monitor the resale inventory and adjust the availability of resale tickets at their discretion.

3. Waitlist Functionality

The Event/ promoter may enable the waitlist feature for events that are sold out, allowing potential buyers to express interest in purchasing resale tickets. Potential buyers on the waitlist may specify their interest in particular resale tickets, including the desired quantity and maximum price they are willing to pay. This information is optional and does not guarantee the availability of tickets. The Event/ promoter may notify individuals on the waitlist when resale tickets become available, using the information provided.

4. Purchase and Distribution of Resale Tickets

Once resale tickets are available, the Event/ promoter may distribute a purchase link to potential buyers via various marketing channels, including social media, text campaigns, and email marketing. The Event/ promoter reserves the right to disable the resale ticket purchase link at any time, rendering the tickets unavailable for purchase.

5. Refunds and Fees

Upon successful resale of a ticket, the original ticket holder will receive a refund for the purchase price of the ticket, less any applicable booking and transaction fees. Refunds will be processed to the original payment method used during the initial purchase. The Platform does not guarantee the resale of any ticket and is not responsible for any failure to resell a ticket.

6. Modifications and Termination

The Event/ promoter reserves the right to modify, suspend, or terminate the resale service and these Terms at any time without notice. Continued use of the Platform following any changes constitutes acceptance of the revised Terms.

7. Limitation of Liability

The Event/ promoter and the Platform are not liable for any losses, damages, or disputes arising from the resale of tickets. Ticket holders and buyers engage in the resale process at their own risk.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].

9. Prohibited Actions

To protect attendees from scalping and fraudulent activities, no private sales, or ticket transfers are allowed. All unwanted tickets must be listed through the official Ticket Marketplace once this option becomes available. Please be aware that private sales are not possible through the Ticket Marketplace.
